Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Kore Web Dynamics LLC (“Company,” “we,” or “us”), a Missouri limited liability company, governing your access to and use of the Agent Four platform (“Service”).

By accessing or using the Service, creating an account, or clicking “I Agree,” you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Agent Four is a SaaS (Software as a Service) platform providing AI-powered voice agents, chat agents, and automation tools designed for business use. Features include but are not limited to: AI agent creation and management, voice call automation, cold calling campaigns, CRM integrations, analytics, and reporting dashboards.

3. Accounts and Access

3.1 Eligibility

You must be at least 18 years old and have legal authority to enter contracts to use the Service. By using Agent Four, you represent that you meet these requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@agentfour.ai if you suspect unauthorized access.

3.3 Organization Accounts

If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and all references to “you” include that organization.

4. Subscription and Billing

4.1 Subscription Plans

Agent Four offers the following subscription tiers (pricing subject to change with 30 days notice):

• Starter: $97/month or $970/year
• Professional: $297/month or $2,970/year
• Business: $597/month or $5,970/year
• Enterprise: Custom pricing — contact sales

4.2 Setup Fees

Certain plans require a one-time setup fee covering onboarding, configuration, and initial agent build. Setup fees are non-refundable and are due before service activation. Setup fee tiers: Basic $497, Standard $997, Advanced $1,997.

4.3 Billing and Auto-Renewal

Subscriptions are billed in advance on a monthly or annual cycle. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on file.

4.4 Refund Policy

Monthly subscription fees are non-refundable. Annual subscription fees may be refunded on a pro-rata basis within 14 days of initial purchase if you have not substantially used the platform. Setup fees are non-refundable in all circumstances. We do not provide refunds for partial billing periods.

4.5 Delinquency

If payment fails, we will attempt to charge your payment method for up to 7 days. If payment remains unsuccessful, your account may be suspended. Data is retained for 30 days after suspension before permanent deletion.

5. Acceptable Use Policy

You agree not to use Agent Four to:

• Violate any applicable law, regulation, or third-party rights
• Send unsolicited communications in violation of CAN-SPAM, TCPA, or similar laws
• Harass, threaten, or deceive any person
• Generate or distribute spam, malware, or phishing content
• Impersonate any person or entity without authorization
• Scrape, crawl, or data-mine the platform beyond normal use
• Attempt to gain unauthorized access to any system or account
• Use the Service to harm minors in any way
• Resell or sublicense access to the Service without written permission
• Reverse engineer, decompile, or disassemble any part of the Service

We reserve the right to suspend or terminate accounts that violate this policy without refund.

6. Voice Calling and TCPA Compliance

The Service includes AI-powered voice calling capabilities. You are solely responsible for ensuring your use of these features complies with all applicable laws, including without limitation the Telephone Consumer Protection Act (TCPA), Federal Trade Commission regulations, and applicable state laws.

Specifically, you represent and warrant that:

• You have obtained proper consent from all persons you contact using AI calling features
• You honor do-not-call registrations and opt-out requests
• You comply with calling hours restrictions (8 AM – 9 PM local time of the recipient)
• You provide required disclosures for AI-generated calls where required by law
• You obtain required consent before recording calls

Kore Web Dynamics LLC is not responsible for your TCPA compliance. You agree to indemnify us for any claims arising from your use of calling features.

7. AI-Generated Content Disclaimer

Agent Four uses artificial intelligence to generate responses, scripts, and communications. AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and approving all AI-generated content before deployment. We make no warranty that AI responses will be accurate, appropriate, or meet your specific needs. You should not rely on AI-generated content for medical, legal, financial, or safety-critical decisions without human review.

8. Intellectual Property

8.1 Our IP

The Agent Four platform, including its software, design, trademarks, and documentation, is owned by Kore Web Dynamics LLC and protected by intellectual property laws. These Terms do not grant you any ownership rights.

8.2 Your Content

You retain ownership of all content you upload or create through the Service (agent scripts, contact lists, configurations). You grant us a limited license to process this content to provide the Service.

8.3 Feedback

If you provide feedback or suggestions, you grant us an irrevocable, royalty-free license to use and incorporate that feedback into the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL KORE WEB DYNAMICS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kore Web Dynamics LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Termination

Either party may terminate the subscription at any time. You may cancel your subscription through your account settings or by contacting support. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or any reason with 30 days notice. Upon termination, your access to the Service will end and your data will be retained for 30 days before deletion.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Greene County, Missouri. You consent to the personal jurisdiction of these courts.

13. Changes to Terms

We may modify these Terms at any time. We will provide 30 days advance notice of material changes via email or in-dashboard notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
